This page sets out the Sales and Returns Policy for this website.

The sales contract is between you, “the buyer” and me, “the artist” Ian Bertram.

Sales Policy

All sales are made under the Consumer Contracts Regulations:

This legislation protects the consumer when buying over the internet or by mail order and applies to all member states of the EU. So far as I can see, this will for the time being continue to apply, after we leave the EU. I reserve the right to amend the sales and returns policy pages if the prevailing law changes.

If you buy from me I aim to ship all items purchased within five (5) working days of receiving payment unless otherwise clearly stated on the product description OR if your identity and/or address cannot be authenticated.

I’m a sole trader so problems may arise from time to time. If that happens I will let you know of any problems as soon as possible, at which point you may:

  1. cancel your order and receive a full refund or,
  2. agree an amended delivery date.

Buying

You must pay for items purchased by you in advance of shipping. I accept BACS, PayPal and Credit or Debit cards. The payment processor I use is Stripe. You may read the Stripe T&Cs here

Returns Policy

When you buy from me, you as the the buyer have the right to terminate the contract and return the item even if the item is not faulty in any way (this is the consumer’s right in UK law). You have the right to do this up to 14 days after receipt of the items and a full refund including the cost of the outgoing postage will be made within 14 days of my receipt of the returned item(s), or within 14 days of you providing evidence that the item(s) have been returned (e.g. proof of postage), whichever is sooner.

You the buyer are responsible for paying for the cost of return postage.

Please note: Unless faulty, the following types of items are non-refundable: items that are personalised, bespoke or made-to-order to your specific requirements; items which deteriorate quickly (e.g. food), personal items sold with a hygiene seal (cosmetics, underwear) in instances where the seal is broken.

Cancelling a transaction.

If you wish to cancel your order, you must inform me in writing that you wish to do so. Notification via email is acceptable, but if provided on the site you may also use a standard returns form. I will provide a full refund of the cost of the item and any outgoing postage costs within 14 calendar days of receiving the returned item(s), or within 14 days of you the buyer providing evidence that the item(s) have been returned (e.g. proof of postage), whichever is sooner. If the goods have not yet been sent, refunds will be sent within 14 days of receipt of the notification of cancellation.

You the buyer are responsible for paying for the cost of return postage.

Return of faulty goods.

You have right to return goods if they develop a fault within six months of receipt. Depending on the circumstances, you may be entitled to a refund (full or partial), a repair or replacement.

Lost items.

If the item is lost in transit I will treat the contract as terminated and provide a refund. No item will be considered missing or lost before the expiry of a period of 45 days from the shippers normally expected date of arrival. This will vary depending on the destination.
