Terms and Conditions of Sale
Who I am
- This website ianbertramartist.uk is owned and operated by me, Ian Bertram, trading as Ian Bertram Artist.
- You may contact me using the contact form here or via email contact@ian-bertram.co.uk
The Artwork
- All artwork offered for sale on this website is my own original work.
- I do not sell reproductions
- The details of what is offered for sale are provided in each individual listing, including dimensions, materials, presentation and condition.
- Variations in screen settings may cause differences in the appearance of colours between the physical image and what is shown on your screen. If the details of colours or textures, or any other variable likely to be affected by the display, are critical to your purchase, please contact me in advance.
- Detailed return policies are here.
Ordering and payment
- All sales are made via the Etsy platform. If you click the Buy button, you will be taken from this website to Etsy, where the transaction will be subject to Etsy’s Terms and Conditions and applicable policies. Where these website terms conflict with Etsy’s terms or policies governing the transaction through its platform, Etsy’s terms and policies will take precedence, subject always to my legal obligations as the seller and your statutory consumer rights.
- All payment processing and order confirmation is handled via Etsy. If you use other channels I may direct you to Etsy.
- In particular, once an order has been placed and accepted by Etsy, all further communications on your order must be via Etsy. This is an Etsy requirement for our mutual benefit.
- The listings on this site show prices in UK Pounds (£). If you are not in the UK, Etsy will convert to the currency you have selected. I have no control over the conversion rates used.
- In the event of a difference in a listing between this website and on Etsy, the Etsy listing will be treated as definitive.
- If for any reason I cannot fulfil an order, you will have the option of receiving a full refund or choosing an alternative item.
Delivery
- See the Shipping Policy, here, for despatch times, delivery arrangements or restrictions.
- Ownership and responsibility for the work remains with me up to the point of delivery to you.
- If an order cannot be despatched as expected, I will contact you via the Etsy platform.
Cancellations and Returns
- For details see the Returns Policy, here.
- Neither the Returns Policy or anything in these Terms and Conditions should be taken as excluding your statutory consumer rights.
Copyright and Intellectual Property
- Buying an original work of art from me does not transfer copyright. Copyright in any artwork sold remains with me, Ian Bertram, unless explicitly agreed otherwise.
- Buyers may not reproduce, distribute or commercially exploit the image without explicit prior consent from me, Ian Bertram. Such permission, if given, may require additional payment.
- Website text, photographs and images may not be copied or reused without authorisation, subject to applicable law.
Disputes and complaints
- If you have a query or problem with anything on the site, please contact me via email or via the contact form. I will aim to respond within seven (7) days.
- If the issue relates to an Etsy transaction you may additionally contact me via Etsy.
- If we cannot agree on a resolution and the issue relates to an Etsy transaction, you may also wish to escalate via Etsy.
- The applicable law for these matters is that of England and Wales, except in the case of an Etsy transaction where their Terms and Conditions will take precedence, subject always to my legal obligations as the seller and your statutory consumer rights.
Changes to these Terms and Conditions
- These Terms and Conditions may be updated from time to time. The latest version will be published on this website, with the date of the most recent revision indicated. Significant changes will be highlighted on the site where appropriate.
