Copyright and Ownership

  1. Copyright in my artwork, photographs, text and other original material on this website belongs to me, Ian Bertram, except where otherwise credited or stated.
  1. When you purchase one of my original art works you acquire ownership of the physical object, not copyright in the image.
  2. I reserve the right to use images of my artwork in other products, including but not limited to apparel, giftware or domestic products. Purchasing an original artwork does not prevent or limit such use.

Moral Rights and Alteration of Images

  1. I assert my right to be identified as the author of my artwork.
  2. My artwork must not be presented in a way that falsely attributes authorship, misrepresents the original work, or implies that I have created or endorsed an altered version when I have not.
  3. I reserve my rights under applicable copyright law in relation to alterations or adaptations of my work, including those made using artificial intelligence (AI). In particular, I reserve the right to object to derogatory treatment of my work where that treatment falls within the scope of my legal rights.
  4. Nothing in this statement is intended to exclude uses permitted by law.

Personal Use and Sharing

  1. You may share Journal posts or listings on social media but a clickable link to the original source is required in every case. Copying and reposting the image itself is not automatically permitted.

Reproduction and Commercial Use

  1. Copying, reproducing, publishing, selling or otherwise commercially exploiting images from this website requires prior permission, subject to applicable legal exceptions.
  2. If permission is granted this may be given subject to a fee and limitations on use.
  3. If permission is granted, attribution to the artist will normally be required. Any agreed variation to the attribution requirements will be specified in the licence, subject to applicable law.
  4. The terms of any permission or license will specify the fee payable, permitted uses and attribution requirements.

Third-Party Material

  1. Images or other material on this site credited to third parties remain subject to their respective copyright and permissions.
